Within the framework of the grant from the EU Law-Justice Project, implemented by Expertise France, the NGO Interregional Expert Center “PRO Justice” is launching a project aimed at a comprehensive analysis of the application of the Law of Ukraine “On Administrative Procedure” (LAP) and a study of the judicial review procedure in administrative proceedings.

In particular, the team of experts will systematically collect and analyze court decisions from open registries to identify patterns, contradictions and potential problems in the application of the LAA and aspects of judicial review. The data obtained will serve as a basis for developing practical recommendations for the implementation of unified approaches to resolving administrative disputes. The study will also allow to assess the effectiveness of judicial review in administrative proceedings, given the possibility of its extension to civil and commercial proceedings.

“Strengthening the rule of law and access to justice in Ukraine is impossible without effective judicial oversight and strict application of the Law of Ukraine “On Administrative Procedure”. Our project is aimed at analyzing and improving these processes,” says Roman Chumak, co-founder and chairman of the board of the NGO PRO Justice.

“The low level of enforcement of court decisions is a global problem of the justice system in Ukraine. Based on the practice of EU member states, judicial review is one of the most effective tools to address it. In Ukraine, the use of judicial review was provided for by courts of administrative jurisdiction, but Law No. 4094IX, adopted at the end of 2024, provides for the use of this tool in certain categories of commercial and civil cases,” says Iryna Zharonkina, Head of the Enforcement of Court Decisions and Protection of Property Rights Component of the EU Pravo-Justice Project.

“The research to be implemented by PRO Justice will allow us to analyze the effectiveness of judicial control in administrative proceedings and help make its institution more efficient for use in all categories of cases,” she emphasizes.
